The Big Picture – Child Safety in School
A petition seeking notification and implementation of guidelines for fixing accountability on schools for the safety of children has been filed in the Supreme Court. The petition has been filed by NGO, Bachpan Bachao Andolan, run by Nobel Prize winner Kailash Satyarthi. The petitioner has prayed for a direction to the Central government to notify and implement the Fixing Accountability of School Management towards Safety and Security of Children in School-Guidelines or Accountability Guidelines. The Accountability Guidelines lay down the responsibilities of school management towards ensuring the safety and security of children in schools, both government and private. The Accountability Guidelines, prepared by the Department of School Education & Literacy, Ministry of Human Resource Development (MoHRD) in consultation with the National Commission for the Protection of Child Rights (NCPCR), have not been notified yet. The cause of action for filing the present petition has arisen because despite there being various laws relating to child safety and security along with the recent Draft Accountability Guidelines, there is no confidence in the implementation of these laws, the petition states. Accountability guidelines:
– prepared by MHRD in consultation with NCPCR.
– 2017: NCPCR – manual for safety of children living in hostels
– 2018: MHRD – identified responsibility to implement guideline PTA & schools
But urgency lacking.
Several cases of abusing child safety in the past:

Issues:
– RTE act – justiciable right but not yet truly implemented.
– CBSE not a statutory body
: legal standing of guideline – should be enforceable.
– These are only preventive guidelines: We do have deterrence laws for the act committed but there is no consequence to private schools.

Steps that can be taken:
– Start implementing the laws please!
– Everyone's responsibility – parents, teachers & society

– Zero tolerance policy: like POCSO act – in case of aggravated assault from position of trust & authority – death penalty.
Safety & security is the right of a student & holistic approach needs to be taken by all stakeholders – government,
teachers & students to achieve that.

Honestly,MHRD is the most crumbling ministry of GOI.
